Regional conditions (10)
Read from the GalvestonDistrict's 2026 nationwide permit public notice. Each condition below narrows, adds a notification requirement to, or otherwise modifies the national rule within this district.
Condition 4 (Fort Worth & Galveston Districts): PCN to the District Engineer required for any NWP activity in designated ecologically sensitive waters, including pitcher plant bogs, sundew habitat, Bald Cypress/Water Tupelo swamps, Karst Zones 1 & 2 (Bexar, Travis, Williamson Counties), Caddo Lake (a Ramsar Convention wetland), and rivers listed on the Nationwide Rivers Inventory.
VerifiedSourceCondition 5 (Fort Worth & Galveston Districts): PCN required for any NWP activity at an approved compensatory mitigation bank or in-lieu fee program site.
VerifiedSourceCondition 6 (Galveston District only): no NWP other than NWP 3 (maintenance) may authorize discharges into mangrove marshes, coastal dune swales, or Columbia Bottomlands. NWP 3 use in these areas requires a PCN.
VerifiedSourceCondition 7 (Galveston District only): PCN required for NWP 10 and NWP 11 activities affecting vegetated shallows (submerged aquatic vegetation/seagrass beds), oyster reefs, or coral reefs.
VerifiedSourceCondition 8 (Galveston District only): NWPs 12, 57 and 58 may not be used within 500 feet of vegetated shallows or coral reefs.
VerifiedSourceCondition 9 (Galveston District only): for NWPs 12, 57 and 58 crossing below non-navigable tributaries, a minimum cover of 48 inches of soil below the river and/or perennial stream thalweg is required.
VerifiedSourceCondition 10 (Galveston District only): PCN to the Galveston District Engineer required for NWP 14 and NWP 18 activities in tidal waters.
VerifiedSourceCondition 11 (Galveston District only): most NWPs may not be used within the standard setback and high-hazard zones of the Sabine-Neches Waterway; PCN required for activities in the medium-hazard zone and for NWP 3 in that corridor.
VerifiedSourceCondition 12 (Galveston District only): most NWPs may not be used within the standard setback zone of the Gulf Intracoastal Waterway; PCN required for all activities within GIWW setback zones.
VerifiedSourceCondition 13 (Galveston District only): any NWP activity within the San Jacinto River Waste Pits Superfund Area of Concern requires a waiver from the Galveston District Engineer and must include a PCN, consistent with the Permit Evaluation Requirement Process (effective 1 November 2009).

What a regional condition can do
- Narrow a nationwide permit within the district, for example by lowering its acreage limit or excluding a resource type the national rule would otherwise cover.
- Add a notification requirement beyond general condition 32, so a project that needs no PCN nationally still has to notify this district before starting work.
- Revoke a nationwide permit inside the district entirely, so activities that would qualify nationally have to seek an individual permit here instead.
