SWPPP requirements in Missouri

Missouri issues its own construction general permit. We have read Construction or Land Disturbance Master General Stormwater Permit, Permit Number MORA00000 and list below the requirements we could cite to it, with the scope limits stated plainly. Screen your own acreage further down.

Who may prepare the plan

No preparer credential found

No preparer credential was found for Missouri. On what we have verified, a generated plan can be adopted by the operator without a credentialed signature. Local ordinances can still be stricter than state law.

Missouri does not gate SWPPP preparation behind any specific certification, license, or professional credential — confirmed as an explicit absence in both the implementing regulation and MoDNR's public program materials. No PE stamp is required by the state permit program for the SWPPP itself (a City of Mexico, MO municipal grading/drainage plan review requires a licensed PE seal, but that is a local requirement layered on top, not a MORA00000 state-permit requirement). Preparers commonly hold voluntary industry credentials such as CPESC as best practice, but none is legally mandated. This conclusion rests on the regulation text and program pages, not a direct read of the full MORA00000 permit document, which is administered entirely through MoDNR's online ePermitting system and was inaccessible (HTTP 403) at every access attempt.

Coverage trigger

Worked through at 3 acres

The project disturbs 3 acres, at or above the 1 acre threshold, so it needs permit coverage.

The trigger people miss is the second one. A half acre lot inside a 40 acre subdivision is covered, because the larger common plan of development or sale is what counts, not the lot.

Read these before you act on the answer

  • Requirements below are what we have read and cited directly from Construction or Land Disturbance Master General Stormwater Permit, Permit Number MORA00000, not the federal CGP. A category we have not yet transcribed from this permit is omitted here rather than assumed to match EPA's rule.
  • The permit number MO-R100007 originally supplied as known context does not correspond to the general permit private construction sites actually use -- MO-R100xxx ('Area-Wide Land Disturbance Stormwater General Permit') is issued only to governmental jurisdictions. The general permit individual private developers/contractors use is MO-RA00000 ('Land Disturbance Stormwater General Operating Permit'), confirmed via DNR's own program page. This dataset covers MO-RA00000. DNR's static document server still serves the PRIOR permit cycle text (HTTP-verified last-modified 2017-02-06, effective 2017-02-08, expired 2022-02-07) -- it was never updated after the 2022 renewal. DNR's overview page confirms 'The current permit expires Feb. 7, 2027' (a newer cycle exists) but its full operative text could not be located/fetched (DNR's water pages return HTTP 403 to automated fetches). All substantive figures below are verified against the 2017-2022 text -- the most recent full permit text obtainable -- not an independently confirmed 2022-2027 copy. The current cycle's effective date is not verified with a direct quote and is set to null. No federal-style acreage-tiered stabilization schedule, sensitive-waters increased-inspection rule, arid/semi-arid reduced-inspection rule, or fixed-day NOI/NOT deadline was found in the fetched text, so those canonical ids are omitted.
  • No preparer credential was found for Missouri. On what we have verified, a generated plan can be adopted by the operator without a credentialed signature. Local ordinances can still be stricter than state law.
  • Basinwise does not perform the physical site inspections the permit requires. Those must be carried out on site by a qualified person.

What the permit requires of a Missouri site

Worked for a three acre site with the receiving water unconfirmed. Each line says why it attached to this site rather than in general. Check the notes above for the site sizes this permit does not cover.

Filing

Plan before Notice of Intent

The SWPPP must be developed prior to issuance of the permit and must be specific to the land disturbance activities at the site; a Missouri State Operating Permit that specifically identifies the project must be issued before any site vegetation is removed or the site is disturbed.

The SWPPP must be developed prior to issuance of the permit and must be specific to the land disturbance activities at the site.

Inspections

Inspection frequency, option 1
7

At least once every seven calendar days, and within 48 hours after any storm equal to or greater than a 2-year, 24-hour storm has ceased during a normal work day (within 72 hours if the storm ceases during a non-work day). This is one of two inspector-selectable schedules; the SWPPP must document which is used.

Why this applies here: You have not confirmed whether the site discharges to an impaired or high quality water. If it does, the increased frequency applies instead and this answer changes.

At least once every seven calendar days and within 48 hours after any storm equal to or greater than a 2-year, 24-hour storm has ceased during a normal work day and within 72 hours if the rain event ceases during a non-work day such as a weekend or holiday

Inspection frequency, option 2
14

Once every 14 calendar days, and within 24 hours of the occurrence of a storm event of 0.25 inches of precipitation or greater, or of runoff from snowmelt.

Why this applies here: You have not confirmed whether the site discharges to an impaired or high quality water. If it does, the increased frequency applies instead and this answer changes.

Once every 14 calendar days and within 24 hours of the occurrence of a storm event of 0.25 inches of precipitation or greater, or the occurrence of runoff from snowmelt.

Who may inspect

These inspections shall be conducted by a qualified person, one who is responsible for environmental matters at the site, or a person trained by and directly supervised by the person responsible for environmental matters at the site.

Why this applies here: This is why Basinwise cannot perform your inspections. The permit requires a trained person physically on the site.

These inspections shall be conducted by a qualified person, one who is responsible for environmental matters at the site, or a person trained by and directly supervised by the person responsible for environmental matters at the site.

Stabilisation

Initiate stabilisation

Immediately -- upon either temporary cessation of soil-disturbing activity on any portion of the site for a period expected to exceed 14 calendar days, or permanent cessation.

Why this applies here: This applies at both land disturbance amounts.

For soil disturbing activities that have temporarily ceased on any portion of the site and will not resume for a period exceeding 14 calendar days: ... Stabilization must be initiated immediately and completed within 14 calendar days.

Corrective action

Corrective action, major fix
7

Any structural or maintenance problems noted during an inspection must be corrected as soon as possible but no more than seven calendar days after the inspection.

Any structural or maintenance problems shall be noted in an inspection report and corrected as soon as possible but no more than seven calendar days after the inspection.

Buffers

Natural buffer
50

For surface waters of the state, the permittee must either provide/maintain a 50-foot undisturbed natural buffer, a smaller buffer supplemented by equivalent controls, or (if infeasible) controls achieving the equivalent sediment-load reduction.

Provide and maintain a 50-foot undisturbed natural buffer; Provide and maintain an undisturbed natural buffer that is less than 50 feet and is supplemented by erosion and sediment controls that achieve the sediment load reduction equivalent to a 50-foot undisturbed natural buffer; or If infeasible to provide and maintain an undisturbed natural buffer of any size, implement erosion and sediment controls to achieve the sediment load reduction equivalent to a 50-foot undisturbed natural buffer.

Records you must keep

Record retention
3

The permittee must retain copies of the general permit, the SWPPP and all amendments, monitoring/analysis results, and all site inspection records for at least three years from the date of the Letter of Termination.

Why this applies here: The clock runs from permit expiry or termination, not from when the record was written, so on a multi year project every record stays live for the whole project plus three years.

The records shall be retained for a period of at least three years from the date of the Letter of Termination.

Total land disturbance over the whole project, including staging and access. This decides whether you need a permit at all.

Optional. If you phase the work, the most that will be disturbed at once. Leave blank if the whole site is open together. The stabilisation deadline turns on this figure, not the total.

A half acre lot inside a 40 acre subdivision is covered even though the lot alone is under the threshold. This is the most commonly missed trigger in the permit.

Receiving water and site conditions(optional, but they change the inspection frequency)

May allow a reduced inspection frequency during the seasonally dry period.

What people ask about SWPPP requirements in Missouri

What are the SWPPP requirements in Missouri?

Missouri issues its own construction general permit, and we have read Construction or Land Disturbance Master General Stormwater Permit, Permit Number MORA00000. The requirements listed on this page, such as inspection frequency, who may inspect, stabilisation, corrective action and record retention, are cited to that permit rather than to EPA's. Anything we have not transcribed is left out instead of assumed to match the federal rule, and the scope note on this page says which sites the permit does not cover. Confirm the current permit and any site-size variant with Missouri Department of Natural Resources (MoDNR), Water Protection Program, Division of Environmental Quality.

Who may prepare a SWPPP in Missouri?

No preparer credential was found for Missouri. On what we have verified, a generated plan can be adopted by the operator without a credentialed signature. Local ordinances can still be stricter than state law.

How often must a Missouri site be inspected?

The inspection frequency is set by the Missouri construction general permit, which we have not read. Confirm it with Missouri Department of Natural Resources (MoDNR), Water Protection Program, Division of Environmental Quality.
