Coverage trigger
The project disturbs 3 acres, at or above the 1 acre threshold, so it needs permit coverage.
The trigger people miss is the second one. A half acre lot inside a 40 acre subdivision is covered, because the larger common plan of development or sale is what counts, not the lot.

Requirements apply when surface water is located within 50 feet of the project's earth disturbances. The operator shall ensure discharges through the area between disturbed portions and surface waters within 50 feet are treated by an area of undisturbed natural buffer and/or additional erosion and sediment controls achieving equivalent sediment-load reduction.
